Welcome to kapilbhandari.in. These Terms & Conditions ("Terms") apply to the services provided by Kapil Bhandari, an independent freelance digital marketer based in Delhi, India ("I", "me", "my", or "Kapil Bhandari").
My services include SEO, Google Ads, Meta Ads, digital marketing, WordPress website development, website design and development, website maintenance, content writing, product descriptions, website content, blogs, articles, and other related digital marketing services.
By purchasing or using my services, you agree to these Terms and any project-specific quotation, proposal, or scope of work agreed with you.
1. Services and Project Scope
I provide freelance digital marketing and website-related services according to the scope agreed with the client.
Depending on the project, services may include:
- Search Engine Optimisation (SEO)
- Keyword research and SEO strategy
- Google Ads management
- Meta Ads management
- Digital marketing
- Lead-generation campaigns
- WordPress website development
- Website design and development
- Website maintenance
- Content writing
- Product descriptions
- Website and homepage content
- Blog and article writing
- Other services specifically agreed upon
The exact services, deliverables, pricing, and estimated timeline will be communicated before the project begins.
Only work included in the agreed scope is covered by the quoted price. Requests outside the agreed scope may be treated as additional work and may involve additional charges.
2. Payment Terms
Unless otherwise agreed in writing, my standard payment structure is:
25% Advance:
A 25% advance payment is required before work begins. This payment confirms the project and allows me to schedule and start the work.
50% After One Week:
A further 50% of the agreed professional service fee is payable exactly one week after the project begins. This payment is part of the agreed payment schedule and is not dependent on the project being completely finished.
Final 25%:
The remaining 25% is payable when the project is completed and ready for final delivery.
Final delivery, handover, transfer of relevant files, or administrative access may be completed after the final payment has been received.
Payment Delays:
Payments are expected according to the agreed schedule. If a payment is delayed, I may pause the project until the outstanding amount is received. Any resulting delay in the project timeline caused by late payment will not be considered a delay on my part.
3. Domain, Hosting and Third-Party Costs
Domain and hosting are not included in my professional service pricing unless specifically mentioned in your quotation.
I can guide you in choosing a suitable domain name and hosting provider, but the client is responsible for purchasing and maintaining them.
Whenever possible, I recommend that domain and hosting accounts be purchased in the client's own name and email address so the client retains ownership and control.
Other third-party costs may also be separate from my service fee, including:
- Premium WordPress themes
- Premium plugins
- Software subscriptions
- APIs
- Stock images or videos
- Email services
- Google Ads budget
- Meta Ads budget
- Other third-party tools or services
Third-party charges are subject to the policies of the relevant provider.
4. Client Responsibilities
The client is responsible for providing accurate and complete information required to complete the project.
This may include:
- Business information
- Product and service information
- Brand details
- Logos
- Images
- Website content
- Product details
- Website access
- WordPress access
- Advertising account access
- Analytics access
- Business goals
- Required documents
- Approvals and feedback
The client is responsible for ensuring that the information and materials provided are accurate and lawful.
If required information, access, feedback, approval, or payment is delayed, the project timeline may also be delayed.
I will not be responsible for delays caused by the client's failure to provide the information or access required to complete the work.
5. Weekly Project Meeting
For ongoing projects, I generally have a weekly meeting on Saturday or Sunday to discuss project progress.
The meeting may cover:
- Work completed
- Current project status
- Pending work
- Product or business information
- Required information from the client
- SEO or advertising updates
- Available results and metrics
- Problems or issues
- Upcoming work
- Client feedback and approvals
The exact meeting time may be mutually agreed depending on availability.
Regular communication helps ensure that the project remains on track.
6. Communication and Support
For project-related questions, updates, information, and requirements, clients should primarily use the communication channel provided for the project, such as WhatsApp.
I will make reasonable efforts to respond to messages and queries.
For calls or video calls, I am generally available between:
7:00 PM and 9:00 PM IST, every day, subject to availability.
Calls outside this time may be arranged by mutual agreement.
Response times may vary depending on workload, technical issues, holidays, or other circumstances.
7. Revisions and Changes
I want clients to be satisfied with the completed project, so reasonable revisions are included within the agreed service.
Unless otherwise stated in the project quotation, up to three rounds of revisions after final submission are included.
A revision means a reasonable change to an existing deliverable within the original agreed scope.
Examples may include:
- Correcting factual information
- Changing product information
- Correcting spelling or grammar
- Replacing provided images
- Reasonable content changes
- Minor text changes
- Minor adjustments to an existing design
After the three included revision rounds, additional changes may be charged separately.
8. Major Changes After Final Submission
Once the project has been completed and submitted, major changes to the original approved scope are not included.
For example, changes such as:
- Changing the entire website design
- Rebuilding completed pages
- Changing the approved layout completely
- Adding major new functionality
- Adding new sections or pages outside the scope
- Completely changing the original project direction
May be treated as additional work and charged separately.
However, reasonable changes to content, product information, text, or images may be accommodated within the included revision process.
The purpose of this rule is to distinguish normal corrections from requests to substantially change an already completed project.
9. SEO Results and Rankings
SEO performance depends on many factors outside my control, including search-engine algorithms, competition, industry trends, website history, content, backlinks, technical factors, and user behaviour.
Therefore, I do not guarantee:
- First-page Google rankings
- A specific Google ranking
- A specific position
- A specific amount of organic traffic
- A specific number of leads
- A specific number of sales
- A specific timeframe for achieving rankings
Search rankings can change frequently, including from day to day.
I will use reasonable professional efforts and appropriate SEO strategies to improve the website's search visibility and performance, but specific rankings cannot be guaranteed.
10. Digital Marketing and Advertising Results
Digital marketing and advertising results depend on many factors, including:
- Market conditions
- Competition
- Industry trends
- Advertising budget
- Customer behaviour
- Product or service quality
- Pricing
- Website quality
- Landing pages
- Sales process
- Seasonality
- Google and Meta algorithms
- Changes to advertising platforms
Therefore, I do not guarantee specific marketing metrics or business results.
This includes, but is not limited to:
- Leads
- Sales
- Revenue
- ROI
- Cost per lead
- Cost per acquisition
- Website traffic
- Conversion rate
- Reach
- Impressions
- Clicks
- Search rankings
I will make reasonable professional efforts to achieve the best practical results based on the agreed strategy, available information, and budget.
11. Lead Generation and Lead Conversion
Where my services include lead generation, my responsibility is to create and manage marketing activities intended to generate potential leads according to the agreed scope.
Generating a lead and converting a lead into a customer are different processes.
I am not responsible for converting leads into sales unless a separate sales or conversion service has been agreed.
The client is responsible for:
- Contacting leads
- Following up
- Answering customer questions
- Providing quotations
- Negotiating prices
- Closing sales
- Delivering products or services
- Customer support
The number of leads that become customers can depend heavily on the client's response time, pricing, product quality, sales process, reputation, and customer service.
12. Advertising Platforms
For Google Ads, Meta Ads, and other advertising platforms, I work within the rules and functionality of those platforms.
I do not control third-party advertising platforms and cannot guarantee:
- Ad approval
- Account approval
- Continued account access
- Specific advertising costs
- Specific reach or impressions
- Specific clicks
- Specific leads
- Specific conversions
Google, Meta, and other platforms may change their policies, algorithms, pricing, targeting options, or review processes at any time.
If an advertising account is rejected, restricted, suspended, or otherwise affected by a platform, I may provide reasonable assistance within the agreed scope, but I cannot guarantee that the platform will approve or restore the account.
13. Content Writing
Content is created based on the information, instructions, references, and materials provided by the client.
The client is responsible for ensuring that information provided about products, services, prices, features, claims, certifications, or businesses is accurate.
If content relates to legal, medical, financial, regulatory, or other specialised subjects, the client should review the content with an appropriately qualified professional before publishing it where necessary.
I do not guarantee that written content will achieve a particular ranking, traffic level, conversion rate, or business result.
14. WordPress and Website Services
For WordPress and website projects, the features included will depend on the agreed scope.
Additional features or functionality may require additional charges.
This may include:
- Additional pages
- Custom functionality
- Advanced integrations
- Payment gateways
- APIs
- E-commerce features
- Advanced animations
- Custom development
- Additional design work
- Premium plugins or themes
Third-party WordPress plugins, themes, hosting services, APIs, and other software may experience updates, compatibility issues, outages, price changes, or discontinuation.
I will make reasonable efforts to resolve issues within the agreed scope but cannot guarantee uninterrupted operation of third-party services.
15. Client Accounts and Access
Some projects require access to WordPress, hosting, advertising platforms, analytics tools, social media accounts, or other third-party services.
The client is responsible for providing the necessary access and ensuring that I am authorised to use the relevant account.
I will use access only for legitimate project-related purposes.
Where possible, important business accounts should remain owned and controlled by the client.
Clients should not share unnecessary passwords or sensitive information.
16. Client Materials and Intellectual Property
The client remains responsible for the materials they provide, including:
- Logos
- Images
- Product information
- Brand assets
- Existing content
- Business information
- Other materials supplied for the project
The client confirms that they have the necessary rights or permissions to use these materials.
The client is responsible for copyright, trademark, licensing, or other legal issues relating to materials they provide.
Third-party assets such as premium plugins, themes, fonts, stock images, software, and other licensed materials remain subject to their respective licences and terms.
17. Unlawful Businesses and Activities
I do not knowingly provide services for illegal businesses, unlawful activities, fraudulent schemes, or activities intended to violate applicable laws or platform policies.
I reserve the right to refuse, pause or discontinue work if I reasonably believe that:
- The business or activity is illegal
- The requested work would facilitate illegal activity
- The client is requesting deceptive or fraudulent material
- The client is attempting to misuse an advertising platform
- The requested activity violates applicable law or platform rules
I may request additional information where reasonably necessary to understand the nature of a business or project.
18. Project Delays and Circumstances Outside My Control
I will make reasonable efforts to complete projects according to the agreed timeline.
However, timelines may be affected by:
- Late client responses
- Missing information
- Delayed approvals
- Late payments
- Hosting problems
- Internet or technical failures
- Third-party service outages
- Google or Meta platform changes
- Cybersecurity incidents
- Natural disasters
- Other circumstances outside my reasonable control
Where reasonably possible, I will communicate significant delays and work to continue the project as soon as practical.
19. Refunds and Cancellation
Refunds and cancellations are governed by my separate Refund & Cancellation Policy.
That policy explains:
- Cancellation before work begins
- Cancellation after work begins
- Calculation of refunds based on completed work
- Treatment of domain and hosting costs
- Advertising expenses
- Third-party costs
- Refund processing
The Refund & Cancellation Policy should be read together with these Terms.
Nothing in these Terms is intended to remove any mandatory rights provided by applicable law.
20. No Guarantee of Business Results
I provide professional services using reasonable skill, care, and effort.
However, marketing, SEO, advertising, website development, and content services cannot guarantee a particular business outcome.
I do not guarantee a specific amount of revenue, sales, customers, leads, traffic, rankings, advertising return, or other business metric unless a specific written guarantee has been separately agreed.
My responsibility is to perform the agreed professional work; the final business result can depend on many factors outside my control.
21. Privacy
Personal information collected through my website is handled according to my Privacy Policy.
Clients should review the Privacy Policy for information about how personal data may be collected, used, stored, and processed.
Where a client provides personal information belonging to their own customers or users, the client is responsible for ensuring that they have the necessary authority and lawful basis to provide that information for the relevant project.
22. Changes to These Terms
I may update these Terms from time to time to reflect changes in my services, business practices, technology, or applicable legal requirements.
The updated version will be published on this page with a revised Last Updated date.
For an existing project, specific terms already agreed in writing will generally continue to apply unless otherwise agreed or required by applicable law.
23. Governing Law
These Terms are intended to be governed by the laws applicable in India, subject to any mandatory rights or protections that may apply to a client under the laws applicable to them.
Nothing in these Terms is intended to unlawfully restrict rights that cannot legally be excluded.

25. Acceptance
By requesting, purchasing, or using my services, you confirm that you have had the opportunity to review these Terms & Conditions and agree to them together with any applicable quotation, proposal, scope of work, and Refund & Cancellation Policy.
If you do not agree with these Terms, please do not proceed with the relevant service.
